Naweza kumbuka hio day vizuri. Nilikuwa nimetoka kuvuna hio siku. Nilikuwa nimechoka kabsaa, kitu tu nilitaka ni kuoga kukula na kulala niamkie the next day kumalizia kuvuna.
Judge :
Go on, what happened then?
Accused :
Ju ya venye nilikuwa nimechoka, nililala ka mawe hadi nikaamka suddenly ju ya uchungu.
Judge :
So what do you think caused this pain?
Accused :
Kusema ukweli, sijui, kitu najua ni niliamka tu with my member, Mr Abdalla, amesimama kama post ya bendera. Kenye inanishangaza ni mara zote my member amesimama na tangu aanze kusimama, hii ilikuwa mara ya kwanza I felt any kind of pain.

I’m curious, can you describe the kind of pain you felt at that time?
Accused :
Hio chungu, weeh, nitailinganisha na nini sasa? Ilikuwa worse kuliko hata ya mama anazaa hosi

Kuna kitu ilinishangaza saa hio,

And what is that, what surprised you?
Accused :
Nilisikia tu nguvu mpya imetoka from nowhere then nikasikia mwili si yangu kabsaa.
Judge :
What do you mean when you say, you felt that your body is not yours?
Accused :
Ni kama nakuwa controlled na kitu ama mtu, movement si yangu at all. Nikajipata naamka kutoka kwa kitanda na kuanza kutembea, hio time hadi usingizi imeisha. Natembea tu, ni kama sleepwalking but nilikuwa awake. Nashangaa nini hii inaendelea?
Natembea tu, nikielekea nyuma ya nyumba. Chenye niliona venye nilikuwa nyumba ilinistua sana.
Judge :
What did you see when you went at the back of the house?
Accused :
Niliona wanawake wawili, uchi wa mnyama ni kama wamejipaka damu ama kitu niliona ka damu. Kila pahali ni manyoya ya kuku, damu, na nyungu imevunjika, alafu kulikuwa kunanuka vibaya sana.
Judge :
And?
Accused :

That’s very serious, is there anything else you can remember?
Accused :

Judge :
I have deliberated on the issue at hand with the seriousness it deserves. Rape is a very serious offence, and whoever is found guilty deserves the full force of the law, that much is true.
The case at hand seems the prosecutors’ wanted to crucify the victim instead of seeking to punish the wrong party. If I had paid attention to one side of the coin, an innocent soul would have been behind bars doing time and that is something that the court can’t allow.
For where is justice, when such an error would have been allowed to occur? That being said, I hereby find this man to be innocent on all charges brought forward against him.
The prosecutors have a fortnight to file an appeal or else lay this matter to rest for eternity.
